CALL TO ORDER: Meeting called to order by Mayor Scott Fleetwood

ROLL CALL: Upon call of the roll, the following aldermen were present: Herman Davis, Delmar Guthery, Don Davidson, Leon Harris.

APPROVAL OF MINUTES: Minutes of September 28, 1998, meeting were mailed to Aldermen for their review. Motion made by Don Davidson to approve minutes. Second to the motion by Leon Harris. Motion carried. All in favor.

CITIZEN’S COMMENTS: Joyce Clinkingbeard came before Board to address traffic problem at the school between elementary and high school. Near the crosswalk on N.E. 9th Ave., people park to pick up students and pull out into traffic without looking causing a safety hazard. She said 150 to 200 children are being picked up there after school, plus the bus traffic. She said she has talked to Superintendent Maynard Wallace, and they would like help from the City to remedy this problem. One possible solution is to make N.E. 9th and N.E. 10th Avenues one way, 9th Ave. travelling east and 10th Ave. travelling west. Another possibility is to partially close 9th Ave. for a period of time in the afternoon. Mayor asked about John Wallace and Randy O’Dell, teachers in the vocational agriculture department, making gates to shut off the street on each side of the crosswalk from 2:30 – 3:30 P.M. Board was in agreement to try partially closing off 9th Avenue from 2:30 – 3:30 P.M. The school will start putting up barricades on Monday Oct. 19th. Mayor has asked police officers on duty to patrol area for a few weeks after this begins. The Herald will publish this in the newspaper and KKOZ will announce on the radio this decision to begin closing off the street starting next week.

AIRPORT FUEL TANK REMOVAL: A bid has been received from Sunbelt Environmental Services, Inc., for closure of two underground storage tanks at the Ava Airport. Mayor said two other companies will be sending bids and he should have these for next meeting. This matter is tabled until next meeting. Mayor said we will try to sell fuel that is left in the tanks – he will check into price per gallon. These tanks must be out of use by December 22nd of this year.

ADVERTISE BID OPENING FOR WATER STORAGE TANK/NOV. 4, 1998: Separate sealed bids for the construction of a 300,000 gallon ground storage reservoir, above ground packaged booster pump station, standby generator, telemetry system upgrade, waterline extension with road bore, and access road will be received by the City of Ava, at the office of the Mayor in City Hall until 2:00 o’clock P.M., on November 4, 1998, and then at said office publicly opened and read aloud.
Information for Bidders, Form of Bid Form of Contract, Plans, Specifications, and Forms of Bids Bond, Performance and Payment Bond, and other contract documents may be examined at this office of Scott Consulting Engineers, P.C., in Springfield. Copies may be obtained upon a nonrefundable payment of $50.00 for each set.
Mayor reported that DNR has given final approval on design.

ANNEXATION REQUEST: Wade/Amyx petition for annexation has been received. This property is located by Perry Pool’s residence on N.E. 10th Street. Aldermen said they would like to annex enough property to square-up the boundaries. Mayor said he will check to see who owns property there that would be annexed. There was discussion about where City sewer and water lines run along N.E. 10th Street.
Mayor said a public hearing will need to be scheduled. Information on annexation procedure will be available at this meeting.

GARAGE SALES AT MULTI-FAMILY HOUSING UNITS: Mayor said issuing the new Garage Sale Permits has been going well. Rick Engelhardt, manager of Fox Trot Apt. complex, called with questions about the garage sale ordinance. The Fox Trot Apartments have asked their tenants to not have garage sales set up in front of each apartment, but they can use the community building at the complex. He questioned if they were limited to only three sales per year since they will be at the same building. There are 24 units and he thinks each tenant should be allowed to have three garage sales each per year. Aldermen agreed that it is likely not all 24 tenants will be having garage sales. They were in agreement that each tenant be allowed to have three garage sales per year. Each tenant must apply for a Garage Sale Permit.
Herman Davis brought up that at the Voyne Merritt residence on N.W. 12th, there are cars and bicycles continually for sale, and he does not have a dealer license of any kind. Mayor asked Jerry Huffman to talk to Mr. Merritt.

LOCK-OUT ON CARS: Mayor said he would like to see the City stop handling the lock-out calls on cars. If we should have an occurrence where an officer is hurt, City has the liability. Dennis Collins has tools to do this, and City would be able to refer calls to him. This matter will be put on agenda for next council meeting.

BRUSH CHIPPER FOR BRUSH CREW: Chipper that brush crew is currently using is 20 years old. Two bids have been received:

Vegetation Management Supply brought down a Bandit Model 200 x P, 80 HP John Deere diesel brush chipper for brush crew to try out. They used it all day and said they preferred this model. They feel it is a more durable piece of equipment and safer to use. Aldermen agreed that as much work as the brush crew does the City would benefit in buying this chipper. Vegetation Management Supply will sell the one the brush crew has been trying out so there will be no delay in waiting for delivery. The cost of this chipper is $22,810 with a trade-in allowance of $3,129.40, bringing the total sale amount to $19,680.60. Mayor suggested checking into getting a low interest rate and making installment payments on this. Board was in agreement. Motion made by Leon Harris to go ahead and purchase brush chipper the brush crew is using, from Vegetation Management for total purchase price of $19,680.60. Second to motion by Herman Davis. Motion approved. All in favor.

SNOW PLOW FOR STREET DEPARTMENT: City received bid from Bus Andrews:

SOCCER PICTURES – PARK DEPARTMENT: Three bids were submitted:

Each bidder presented costs for different photo packages, so it was difficult for aldermen to compare prices. Motion made by Don Davidson to stay with Making Memories for soccer pictures. Second to motion by Leon Harris. Motion approved. All in favor.

ACCOUNTS PAYABLE: Accounts payable cash requirement report was submitted to Aldermen for their review. Motion made by Herman Davis to approve accounts payable expenditure of $31,664.84. Second to motion by Don Davidson. Motion approved. All in favor.
An invoice was submitted by Justin Colburn for work done at the fire station. Motion made by Herman Davis to approve paying Justin Colburn for this work. Second to motion by Delmar Guthery. Motion approved. All in favor.
Mayor said new sanitation department truck will be delivered Wednesday morning by Downing Sales.

Motion made by Leon Harris to adjourn meeting. Second to motion by Don Davidson. Motion approved. All in favor.
